Information for Claiming Monetary Relief Under Abercrombie & Fitch Consent Decree



As reported in last month's newsletter, the Equal Employment Opportunity Commission (EEOC) filed a lawsuit alleging that Abercrombie & Fitch, et al., discriminated against applicants and employees based on race, national origin, color and gender who were Black, Hispanic, Asian, and women. The EEOC suit was consolidated with two private cases filed as class actions, Gonzalez v. Abercrombie and Fitch, et al., and West v. Abercrombie & Fitch, et al. On November 16, 2004, the Court granted preliminary approval to a settlement of the lawsuits, which allocated $40 million to a class fund to compensate persons who were discriminated against.

The EEOC has recently announced that women, African American, Asian American, and/or Hispanic who: 1) applied for employment or management (or attempted to do so and were discouraged), or 2) were employed at an Abercrombie & Fitch store (including Abercrombie kids and Hollister Stores) at any time between February 24, 1999, and November 16, 2004, MAY HAVE A CLAIM.

Those individuals who believe they are a victim of such employment discrimination, and wish to make a claim, must contact the claims administrator to request a claims form by calling the toll-free number (866) 854-4175, or e-mailing their request to: info@abercrombieclaims.com.
